Warehouse Accident Claim London

Mr V instructed us to deal with a claim following an accident at work.

Mr V was working in an Electrical Retail Establishment at the time of this accident. He was attempting to find a TV stand that are kept on a high shelf in the warehouse.

To do this, he had to climb up a ladder, which was the usual practice at his workplace.  However, he could not find what he was looking for, so he decided to go back down the ladder.  However, as the ladder had a screw missing, Mr V was not able to put his feet flat on the steps but had to walk down on tiptoes. This caused him to slip halfway down and fall off the ladder.

At the bottom of the ladder, there was a pallet full of products. Unfortunately, Mr V landed with the outer rim of his foot on the edge of the pallet and sustained a Jones fracture to the 5th metatarsal of his right foot.

How was Mr V affected by these injuries?

Work aspect

Mr V was off work for nearly 3 weeks after his injury initially. When he returned to work, he was wearing a boot for up to 6 weeks and so walking was challenging. He also avoided carrying any products.

It was approximately 3 to 4 months before he was able to participate in all activities around the workshop. He had some problems at his workplace and therefore he resigned from his job at the end of October 2017. Since then he gained employment through an agency doing customer work such as product sampling in supermarkets before getting his current job, which is a permanent job within Carphone Warehouse.

After Mr V’s surgery, he was in a boot for nearly 2 months so his activities were markedly restricted and after that time and he was able to participate in all activities without too much difficulty.

Domestic aspect

Mr V  found it difficult to participate in domestic tasks. He was able to restart basic tasks like shopping nearly 3 weeks after his injury. These activities were restricted for nearly 2 months after his surgery this included domestic tasks such as vacuuming, cleaning, washing up and shopping.  He needed a lot of assistance from his wife during this time.

Social aspect

Mr V  had considerable difficulty with his sporting activities. It took nearly a year before was able to return to cycling. He was able to restart his costume design 2 months after his injury. He was able to walk 2 weeks after his injury and then stopped for nearly 2 months after his operation.  He stopped jogging and boxing for 18 months and he is now running up to his usual 2 to 3 times a week doing the same distances that he was before. He is now boxing & weight training twice a month instead of weekly. This is because of his friend whom he would do train with moved to a different area.

Psychological aspect

Mr V suffered sleep disturbances for nearly 3 weeks before and after his operation. He remained quite anxious and this disturbed his sleep due to the anxiety. He was unable to participate in his usual activities and this caused additional anxiety due to the fact that his wife was doing most of the housework for him. He suffered interference with his intimate life with his wife for 3 weeks after his injury and for 6 weeks after his operation.
