The extent of the injury
In order to qualify for compensation, you must prove that the accident was caused by the fault of the other party or was partly their fault. This means that the other driver had some responsibility for causing the accident. You also need to show that you suffered injuries as a result of the accident.
You can do this by producing a medical report so it is important that you visit your doctor or the hospitals as soon as possible after your accident to check your injuries and obtain treatment. This report will form the basis of your injury claim but you can also claim financial losses such as loss of earnings and care you have needed from relatives or friends during your injury period.
The cause of the motorcycle accident
In order to determine how much compensation, you might be eligible for, you must first establish whether the other driver was negligent. This means that he or she had a legal duty to act reasonably when driving his or her motorcycle or car. If the other driver failed to do so, then you may be able to claim damages against him or her.
Whether or not the other driver was at fault
There are two main ways that you can prove negligence. First, you can show that the other driver broke the law. Second, you can demonstrate that the other driver acted unreasonably under the circumstances and was negligent. If you are able to prove that the driver who caused your accident broke the law, this helps you to prove they were negligent. However, just because you cannot prove the driver of the motorcycle or other vehicle broke the law does not mean that you will not be able to prove that they were negligent.
What sort of motorbike you were riding
These can range from three wheelers, cruisers, scrambler bikes, modified bikes and electric scooters. Some three wheelers will tip over at low speeds crushing or trapping the driver whereas cruisers such as Harley Davison’s, Honda and Indian are extremely heavy and can cause severe injuries if they land on you. Electric scooters or E-Scooters are considered high risk and are only allowed on private land except in certain public places where trials are running.
The age of the injured person
If the injured person was under 18 years old at the time of the accident, then you cannot make a claim against the negligent party as they do not have legal capacity. Usually they will have to appoint a responsible adult for you to sue. In addition, the parents of minor children will usually bring compensation claims on their behalf.
How much compensation will I get for my motorcycle accident?
You can claim compensation for the pain and suffering from your bodily or psychological injuries as well as compensation for lost earnings, medical treatment and operation costs, care by friends and relatives because of your injuries and extra housework or child care.
What sort of injuries usually occur in a motorcycle accident claim?
Common injuries which occur from motorcycle accident claims are head injuries, neck injuries, back injuries, cracked ribs and fracture hips as well as internal bleeding, spinal injuries and other bone fractures.
